Policies & Procedures

Client(s), for good and valuable consideration, the receipt of which is acknowledged, hereby grant  EB Pixs., its legal representatives, assignees, and those acting under its authority, the unrestricted right and permission to copyright and/or use, and/or publish photographic portraits or pictures of the Client(s), and the negatives, transparencies, prints, or digital information pertaining to them, in still, single, multiple, moving or video format, or in which  Client(s)  may be included in whole or in part, or composite, or distorted in form, or reproductions thereof, in color or otherwise, in any media for advertising or any other lawful purpose.

Client(s),  hereby relinquishes any right that he/she/they may have to examine or approve the finished product or products or the advertising copy or printed matter that may be used in connection with an image that EB Pixs has taken of the  Client(s), or the use to which it may be applied.  Client(s), waives any ownership and publication right he/she/they might be entitled of in connection with the pictures, with the exception of the personal use of the pictures as part of personal modeling portfolio. Client(s),  agrees he/she/they has no right to sell, license or publish any of the pictures to any person or entity. Client(s), has no write to RAW images taken by EB Pixs, and must go with package/project terms unless previously discussed with EB Pixs. 

Client(s),  further releases EB Pixs, its parent company, subsidiaries, affiliates, officers, agents, servants, or employees from any claims for remuneration associated with any form of damage, foreseen or unforeseen, associated with the proper commercial or artistic use of these images unless it can be shown that said reproduction was maliciously caused, produced and published for the sole purpose of subjecting the  Client(s) to conspicuous ridicule, scandal, reproach, scorn and indignity. Client(s), also waives any and all claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, that may be sustained by  Client(s), or any of the property belonging to Client and its affiliates, whether caused by the negligence of the releasees, or otherwise, while performing the photography session and or shoot, or while in, on or upon the premises where the photography session was performed.

It is the express intent of the  Client(s), that this document and acknowledgement of it shall bind all members of Clients family, heirs, assignees and personal representatives.

RESCHEDULING & CANCELLATIONS

Client(s), may reschedule with EB Pixs. from date of original booking in order to satisfy contractual agreement. Rescheduled booking(s) must be within 30 days of previous date unless otherwise agreed upon by EB Pixs.

Client(s), must communicate at least 48 hours in advance if needing to reschedule booking date.

Client(s), agrees to be on time for booking. If you are more than 30 minutes late, please note you are only allotted the duration time agreed upon. EB Pixs, is not required to move other scheduled bookings for late clients.

EB Pixs, reserves the right to schedule or reschedule any session due to illness, personal emergency, or inclement weather. If we are late, we will communicate that with you and your scheduled booking time will not be affected. If needing to move booking to another date, EB Pixs will let the client know at least 24 hours in advance.

EB Pixs. agrees to the following date(s) in order for photography/services to be conducted. In the event of rescheduling and cancellations, EB Pixs. agrees to inform client at least 24 hours in advance of shoot and or session changes.

PHOTOSHOOT/SERVICES DETAILS

Client(s), has agreed to following session/service under the terms discussed with EB Pixs.

EB Pixs, agrees to have a turnaround time of 2-3 weeks prior from date of photoshoot. If Client(s) are in need of images before the designated turnaround time, Client(s) agrees pay the rush editing fee of $50.00 per 20 images. If wanting more images outside of designated package, Client(s) agrees to pay $5 per image.

Client(s), has 2 months from emailed gallery to download edited images from booking. Please back up all digital copies of your images. In the event that you did not download images by expiration date, Client(s) must pay a $30 gallery upload fee in order for images to be re-uploaded.

In regards to all Marriage Licensing, EB Pixs is required by law to follow state regulations in order to assure your marriage and ceremony is valid and legal. 

PAYMENTS & REFUNDS

Client(s), agrees to pay a non-refundable retainer feeto EB Pixs. in order to hold calendar booking and date that is applied to your booking. This fee also covers location scouting, studio time, and planning and/or communication. Fee must be paid by client immediately upon booking your session. It will not be reserved without retainer fee.

Client(s) agrees to pay the additional amount to EB Pixs. on day of booking before EB Pixs releases any digital edits, prints, or products. All bookings are nonrefundable regardless of any stipulation including weather, cancellation, emergencies, etc.

EB Pixs, is dedicated to providing our clients with 100% satisfaction. In the event the photographer and/or officiate have any technical issues (equipment malfunction, computer malfunction, etc.) there will be no charge to re-shoot your session or fix any matters at hand. EB Pixs, cannot offer free re-shoots for any of the following reasons: dissatisfaction with clothing choice, facial expressions, hair, weather, or any other reasons out of our control.

AGE REQUIREMENTS 

Client(s), represents that he/she/they is 18 years or older, that the booking and or shoot(s) was conducted in a completely proper and highly professional manner, and this release was willingly signed or agreed upon before booking takes place. If client is under the age of 18, a signature of release form and or contract must be signed by at least on parent /guardian or attained by client.

PRIVACY POLICY 

EB Pixs, is committed to your privacy. Information collected from clients over the phone, in person, or through the website is kept confidential. Information will not be shared or sold to third parties.
